Letitia James: I'll Take 40 Wall Street

Donald will not like this...

Letitia James says Donald must pay his $453.5 million fraud penalty, or else she’ll SEIZE his buildings. And it gets even more personal. Read on: 👇

In case you were worried that Donald might get away with refusing to pay the massive penalties (plus interest) that Judge Engoron levied against him, I wanted to share some good news.

Not only did A.G Letitia James throw cold water over any hope Donald might have of winning an appeal to this historic judgment against him, she also made it clear that she’s prepared to go to great lengths to get every penny he owes in order to satisfy the judgement.

Donald’s first problem

While Donald’s attorney Alina Habba promised to appeal the judgement, James has already signaled it will be a waste of time:

In remarks during her interview with ABC news, James emphasized that she is “‘very confident’ about the strength of her case on appeal.”

Why? Because Engoron’s conclusions themselves were based on hard evidence – evidence that includes documents that “clearly contain fraudulent valuations that defendants used in business."

This wealth of documents includes financial records, loan applications, and internal communications within the Trump Organization. These documents provided the court with a detailed trail of transactions, valuations, and misrepresentations. No appellate court will be able to ignore such evidence.

Donald’s second problem

"If [Donald] does not have funds to pay off the judgment,” Letitia James told ABC News' Aaron Katersky, “then we will seek judgment enforcement mechanisms in court, and we will ask the judge to seize his assets."

Knowing Donald as I do, here’s why I know this statement will push him closer to the edge:

First, James implies that there’s a possibility Donald does not have enough cash to satisfy the judgment; that alone is enough to enrage him. Readers of The Good in Us know that Donald is obsessed with his net worth and he goes to great lengths to convince people he is enormously wealthy. It’s a significant part of his identity.

The urgency with which he clings to the the false idea that he is richer, more successful, and more talented than he is serves to hide the truth – not just from us, but from himself – that he is, quite simply, a loser.

James took it a step further:

"We are prepared to make sure that the judgment is paid to New Yorkers, and yes, I look at 40 Wall Street each and every day," James said, referring to the Trump Building in Manhattan.

While you’re at it, A.G. James, how about Trump Tower?

Donald’s third problem

Donald owes a $453.5 million because the court applied $98.6 million in pre-judgment interest to the almost $355 million in penalties.

Last year, Donald claimed that he had about $400 million in cash on hand. If that’s the case — and it’s difficult to ascertain whether or not it is — that means he does not have enough to cover the penalty, especially if you add the $83 million he currently owes E. Jean Carroll. If you consider that his debt is constantly increasing, because interest is calculated daily, his chances of avoiding liquidation are in serious jeopardy.

But wait… Can’t Donald just get another loan?

That’s extremely unlikely. First of all, per Engoron’s judgment, Donald can’t even get a loan from any bank chartered in New York. Since so many of the major banks are based here in New York, this is a serious problem.

Secondly, Donald has been found liable for fraud; despite their incredible lenience in the past, it is extremely unlikely he’ll find any bank that would be willing to give him the time of day, let alone half a billion dollars.

If Donald is indeed forced to liquidate his buildings, I have some ideas about how we can repurpose his properties. Stay tuned!
