They certainly do, I single out Merchan in particular because he at least appeared to have some kind of spine when it came to putting Trump in his place. But sadly, he too has utterly disappointed the American people by refusing to do what is morally right because he could not bring himself to damage the office of president despite a clear and obvious history of Trump doing exactly that.

But my point was, that everyone involved & any of the judges involved could have done something, even if it had gotten appealed or reversed later. That is why I said "ALL" involved. Think about this for a few, just how many judges went along with all of the appeals & delays? Knowing full well what Donnie's lawyers were doing. I believe that ANY of those judges/courts could have put a stop to the delays if they had truly wanted to. They sure as heck would have done it to you, me or anyone else. Wishing everyone a very nice 2925.

Jill, that applies to the SCOTUS and down to the lowest courts& judges involved. But another way of looking at the federal judges & courts, what can some of them do to bring about justice, if the higher courts & the SCOTUS is going to continue shooting down & reversing 99.9999% of what they do? I believe that there would be better & even stronger rulings from 99.999% of these judges and courts (both federal & state) if the SCOTUS would back them up more, in their independent sentencing & rulings. These are just my opinions,wishing everyone a nice day.

Since trying to overthrow the president's office, committing crimes & being found guilty, etc. does not remove him or her? Would committing a murder or having one done, still not reach the level to remove them? (A quick aside, it will forever gall me that the man most responsible for disgracing the office of the presidency continues to benefit from the respect others reserve for it—either out of habit or necessity.).

And yet many still speak about the “rule of law” as if the rule of law is not corrupted by those who buy politicians to get the laws in place—citizens United, presidential immunity from crimes, decisions protecting states rights to rig elections, etc., as if the rule of law is just.

Please remember that the whole concept of the rule of law in our legal system was created and formalized by the Colonial UK—which we incorporated into our legal system—to give legal justification for the colonization of other parts of the world so that they could be exploited to increase the wealth of the UK colonizers.

This same rule of law is now used to protect the bloated ticks of human blood in our country.

Joel, just me, but I believe that the SCOTUS, the courts & judges ( with their delay, delay, dragging their feet & showing backbone to stand up for what is/was right. Had more of an impact on the outcome of the court cases than Nancy P, Schummer ever thought about. Remember that there were a lot of GOP VIP's, politicians, MAGA, big $$$$ backers & supporters, that used their influence to get a lot of the delay, delay & appeals done to help Donnie. That the average American citizen will never get or even see in any court or from any judge. Whether you like it or not, Donnie proved that he is above the law by running out the clock, while some of his lawyers are paying a price for going along with him. It seems like Donnie once made the statement that he could shoot someone in broad daylight and nothing would ever be done about it. Just how right he was. Just my opinions, have a nice day

Honestly, Mary, I had very serious doubts that anything whatsoever would stick to the orange sadist. I celebrate today's conviction. Now I'm hoping that either the very weak and meek Garland will -- FINALLY -- do the right thing and release BOTH of Jack Smith's cases; OR the kindly President Biden will do so under the insane SCOTUS immunity ruling; OR some good soul from wherever will release that information that belongs to US: We the People. My understanding is that for defaming the election workers, he CANNOT be pardoned by Trump. The case brought by Freeman and Moss is a civil suit and ‘Donold’ (as ‘God’ calls him) can only pardon federal criminal offenses. I think that is also true of State offenses (like the Georgia horrors, right? And, in fact the New York case). I am NOT a legal expert and hope someone will correct me if I got it wrong.

It’s 2016 all over again: we watch in impotence and horror as this vile criminal damages, undermines, and sullies our country, and we are utterly helpless because WE obey the laws. The law keeps us from expressing or executing any action to effectively protest. Faced with lawlessness we who respect the law are neutralized, waiting sheeplike for…wait for it!—-the MIDTERMS!!! FOR TWO FULL YEARS, the new anti-American president will wale away at our Constitution, steal social security funds belonging to those who earned them, undo as much as he can of Benjamin Franklin’s USPS, bring disgrace and discredit upon our government, betray our allies, and jeopardize the last seventy years of hard-won global stability. Why? That is the question that bedevils me: why? Why is an American president hell-bent on sabotaging the US? Colluding with Putin? Just so he can build more tasteless hotels in the old USSR? Is this why this man who has enjoyed the most sumptuous wealth any nation can provide wants to unmake the source of that wealth? It’s a serious question: WHY?? It makes no sense.

Garland is actually not a democrat! I think that's why he hadnt had him checked out until after the j6 committee gave him their report.

I have been following and interacting with Greg for a while and he does not release things casually. He is a legit investigative reporter. Interesting you bring up Arizona Theresa. A while back Arizona's secretary of state asked John Roberts Brakey to audit the elections there to be sure there wasn't an issue. That time he found none. The repubs got rid of her shortly afterwards. They wanted none of those audits even when they "win". John runs AUDIT Elections USA. A bipartisan org that has been auditing elections for quite a while. Great group to support. He is an expert on machine voting irregularities and how those kinds of steals are done.

None of that proves that Harris won, nor that he stole the election, so we'll have to agree to disagree on that. Again, I would suggest that Harris and other Dems would not let legitimate proof slide. They have brought innumerable lawsuits against the voter suppression tactics/laws of red states, and so have other groups like the ACLU... year after year. So it doesn't even make sense that they would let trump take office if they knew it wasn't a legitimate win.

I will say, too, that we have a responsibility, as citizens, to do our part to protect democracy. That includes our civic duty to register to vote, and to cast an informed ballot. Given that some 90 million eligible voters didn't get to the polls on Nov 5th, I'd say that any successful cheating by trump wasn't the problem. When the largest voting block in the U.S. is (and has been) NON-voters, we certainly have much more to concentrate on than suspicions/allegations of cheating. And seriously, why should Dem legislators, who warned and warned about a close election and what a trump win would mean... keep trying to fight for our rights, when the majority of us don't make it a point to engage?

Jae, Even until Friday I THOUGHT Drumpf would get something. Sucker punched again, I felt like Charlie Brown. Completely duped. Every time it looked like “Aha! We’ve got him now!” something got in the way and justice was stopped in its tracks and the CRIMINAL4547 slipped away.

The only consolation I’m seeing (and it’s likely not consolation for all the many people he hurt) is that he will keep dementing to the point he will no longer be able to stay in office or commit crimes. He will no longer be able to bully people. In the end, he will die unloved and disrespected.

What the country needed right after Joe Biden was elected were tribunals that punished ALL of the MAGA coup actors with either prison, fines and expulsion from politics. That would have set the necessary precedent about what political behavior was acceptable and what wasn’t.

I never thought I'd see the day when someone like L'orange Pustule, a 34-count felon, could walk away without punishment while someone like Leonard Peltier stays in jail for something he didn't do. I'm so thoroughly disgusted with it all and don't know how I'll manage the next 4 years. I know it'll be ugly. :(

I've thought the same thing about my veteran dad, too, Jane. He died in 2017 at the age of 93 and absolutely hated tRump with a passion. He'd be so horrified about what is happening now, and afraid for all of us. Altho in some ways I wish he was here - he always had a very calming influence on me (and most people) and could see hope when others felt hopeless. We could all benefit from his presence now. And his good heart.

I don't know the answer to that, but I do know that Vance doesn't have Trump's charisma. (I don't think Trump has any myself, but obviously some people do.) What this might mean is a leadership vacuum in the Republican Party. And that could lead to it fracturing. That's a guess. I don't really know though. I have no experience with people who have sex with couches.

Careful reading of the 22nd amendment shows that it prevents someone from being >elected< President for more than eight years. Nothing prevents him from >assuming< the office by some other means, for example if he runs for vice president on the ticket and his President - for example, Don Jr. - resigns on day one. He could simultaneously leave the Constitution in place and become President for as long as he lives.

A more certain way to disqualify Trump from the President - ever - would have been disqualification by the 14th amendment through conviction for insurrection. But Attorney General M. Garland, M for Milquetoast, saw to it that this path would not be available to us. Now, his chance of being convicted of insurrection under any AG he appoints is somewhere between zero and, well, zero.

Strictly speaking, none. He has skilled lawyers who can walk him right up to the edge of the law, plus the Supreme Court has his back, thanks to Mitch McConnell who gave him three nominations instead of one. Speaking of Mitch, history will record that he had multiple chances to limit Trump's power, particularly through the second impeachment, post January 6th, when Trump was out of office and convicting him would have had absolutely no impact on the government. If democracy fails in the USA, Mitch will be remembered as one of the chief useful idiots, playing directly into the hands of the Trumpists who already had their return to power planned.

The problem is that the Constitution was written partly assuming that reasonable people would use it as a foundation for governing reasonably. There's lots of checks and balances to prevent political groups from exercising inappropriate power over other political groups, but it doesn't seem like anyone predicted that a single individual would capture an entire center of political power and turn them into his willing pawns. Trump did it more than once, capturing the national Republican party and, with their help, the Supreme Court. Once he's immunized for all official acts, and We the People put "our" confidence in his ability to govern however he wishes, the question of whether the Constitution can withstand the power center he's created.

We'll just have to see how the next two years go - if he isn't controlling the system of statewide elections by then, we may get out of this still standing. But the same talents who got him this far are very aware that 2026 is make-or-break for their quest for absolute, unchallenged power, and you can be sure they will do everything they can to have the midterm elections go their way.

And, as we've seen, they're very, very good at accumulating power.

When I think of what WW2 did to my bio dad after serving in it I feel the same way. Those folks weren't weak like folks are now. They would rise up and do something about it. Now we cannot even be sure the military will not fire upon citizens for protesting this. Kent State on a bigger scale. Some of us asked Scott Air Force Base brass about what they would do about MAGA in their ranks if they went after citizens at a PR type gathering they had and they would not answer.

Judge Merchan is wrong to have concluded that, “It is the legal protections afforded to the Office of the President of the United States that are extraordinary, not the occupant.” He should have sentenced Trump just as he'd sentence any other criminal, and his sentence should have taken effect immediately. That would not put the Office of the President in any danger, and it needs no legal protections. The Constitution takes care of it. The 25th Amendment provides that, if "the President is unable to discharge the powers and duties of his office [perhaps because he is in prison], the Vice President shall immediately assume the powers and duties of the office of Acting President." The Office of the President continues as usual, with no harm done.

The people of this country have the wrong idea about the office of the president; they treat it like the throne of a king. I'm not referring to the outrageous and extralegal finding by the six Republican politicians on the Supreme Court that the president is above the law. I'm referring to the fact that the president is a federal employee -- no more and no less. If a janitor who works for the federal government commits a crime and is sentenced to prison, does that threaten the Office of the Janitor? Of course not. The janitor's position can be filled by someone else while he or she is in prison, just as, under the 25th Amendment, the president's can be.

Section 3 of the 14th Amendment makes Trump ineligible to be president because he engaged in an insurrection. The Republican justices on the Supreme Court issued a ruling that makes it impossible to apply section 3. But nothing in the Constitution gives the Supreme Court the final word in interpreting the Constitution. The Supreme Court gave itself that power in Marbury v. Madison in 1803, and it has become accepted. But now that the Republican justices have gone rogue and ignore the parts of the Constitution and federal laws they dislike, the executive and legislative branch ought to consider rejecting rogue Supreme Court decisions.

But the Democrats instead roll over. The 12th Amendment provides that the President of the Senate, which means the Vice President, shall count the Electoral votes. On January 6, Harris should have protested the vote on the grounds that it is unconstitutional for Trump to be president. It wouldn't have made a difference, except to remind the country of that fact, but that's important. Harris's silence on the matter was a repetition of Al Gore's silence in January 2001, when he did not protest that the Republican justices had stolen the presidency from him in Bush v. Gore. The Democrats need to stand up for themselves, but they won't.
